The agreement governing your use of the Surely platform and services.
These Terms of Service ("Terms") govern your use of the Surely platform and services provided by Surely Ltd ("Surely", "we", "us"). By accessing or using our services, you agree to these Terms.
Surely provides a patient-led health record request platform. Each request is reviewed and authorised by the patient or applicant, who approves what information is shared, who it is shared with, and the purpose for which it is used. Surely connects general practices, recipients nominated by the patient, and applicants through a secure, privacy-aligned workflow.
Organisations using Surely (such as general practices, insurers, and brokers) must be registered businesses or organisations operating in New Zealand and authorised to participate in patient-led health record requests in their respective roles. Individual consumer accounts are not available.

Health records retrieved through Surely may only be used for the purpose stated in the consent provided by the patient or applicant. You must not use health information for any purpose beyond the disclosed and consented purpose. Surely does not retain health record data: once a request has been fulfilled, the data is automatically and permanently deleted from the Surely platform within a defined number of days.
The Surely platform, software, and documentation are the intellectual property of Surely Ltd. You are granted a limited, non-exclusive licence to use the platform for your authorised purposes. You may not copy, modify, or redistribute any part of the platform.
Surely processes personal information in accordance with our Privacy Policy and the New Zealand Privacy Act 2020 and the Health Information Privacy Code 2020. By using the platform, you agree to the collection and processing of information as described therein.
To the maximum extent permitted by law, Surely is not liable for any indirect, incidental, or consequential loss arising from your use of the platform. Our total liability for any claim shall not exceed the fees paid by you in the preceding three months.
Either party may terminate the agreement with 30 days' written notice. Surely may terminate immediately for breach of these Terms, including any violation of consent or privacy requirements.
These Terms are governed by the laws of New Zealand. Any disputes will be resolved in the courts of New Zealand.
We may update these Terms from time to time. We will notify registered users of material changes. Continued use of the platform after notice constitutes acceptance of the updated Terms.
